HIRE TERMS
1. Hire Details
i. The Owner agrees to hire to the Hirer the following equipment (“the Equipment”):
ii. The total hire charge is payable in advance.
2. Use of the Equipment
i. The Hirer must ensure that:
(a) The Equipment is installed, loaded, and used safely and in accordance with manufacturer’s instructions and any guidance from Bootifull;
(b) The Equipment is attached only to a suitable and roadworthy vehicle;
(c) The total roof load (including the Equipment and contents) does not exceed the vehicle manufacturer’s specified limit.
ii. 2.2 The Equipment must not be altered, modified, or used for carrying animals, liquids, or any hazardous materials.
iii. The Hirer must comply with all relevant road traffic laws and regulations while using the Equipment.
3. Condition and Inspection
i. The Hirer acknowledges that the Equipment is in good, clean, and serviceable condition at the start of the Hire Period.
ii. Bootifull may take photographs or complete a condition checklist on collection.
iii. The Equipment must be returned clean and in the same condition, subject to fair wear and tear.
4. Liability and Insurance
i. The Hirer is responsible for the Equipment from the time of collection until it is returned to Bootifull.
ii. The Hirer shall be liable for:
(a) Any loss, theft, or damage to the Equipment (however caused); and
(b) Any damage or injury caused to their vehicle, passengers, or third parties arising from incorrect use or fitting of the Equipment.
iii. Bootifull is not liable for any indirect loss, damage, or injury arising from the use or failure of the Equipment, except where such liability cannot be excluded by law.
iv. The Hirer is advised to check their vehicle insurance policy covers the use of roof-mounted accessories.
5. Return of Equipment
i. 5.1 The Equipment must be returned to Bootiful on or before the agreed Date/Time.
ii. Late returns may incur additional hire charges of per day or part thereof.
iii. If the Equipment is not returned within 1 day of the due date and reasonable contact cannot be made, Bootifull may treat the Equipment as lost and retain the deposit or recover its value from the Hirer.
6. Deposit and Deductions
i. 6.1 Bootifull may deduct from the deposit any amounts necessary to cover:
(a) Loss or damage to the Equipment;
(b) Excessive dirt or cleaning costs;
(c) Late return charges;
(d) Missing parts or keys.
ii. Any remaining balance of the deposit will be refunded to the Hirer within [5–10 business days] of return and inspection.
7. Cancellation
i. If the Hirer cancels the booking more than 48 hours before the start date, any hire fees paid will be refunded in full.
ii. If the Hirer cancels within 48 hours of collection, Bootifull may retain 25% to cover administrative and lost booking costs.
8. General
i. This Agreement is governed by the laws of England and Wales.
ii. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
iii. Bootifull’s standard Terms & Conditions (available at www.bootiful.co.uk) form part of this Agreement.
iv. Both parties agree that this document represents the entire agreement and supersedes any prior discussions.
9. Data Protection (UK GDPR Statement)
i. Bootifull Roof Box Hire (“we”, “us”, “our”) acts as the Data Controller for any personal data collected under this Agreement.
ii. We collect and process your personal information (including your name, contact details, address, driving licence number, and payment details) for the purposes of:
(a) Administering your hire booking and payment;
(b) Verifying identity and driving eligibility;
(c) Contacting you about the hire or recovery of the Equipment;
(d) Processing deposits, refunds, and any damage claims;
(e) Meeting our legal and insurance obligations.
iii. We rely on the lawful bases of contract performance and legitimate interest under Article 6(1) of the UK GDPR.
iv. Your data will be stored securely and retained only for as long as necessary to fulfil the hire contract and meet our accounting or legal obligations (normally up to 6 years).
v. We will never sell or share your personal data with third parties, except where required by law, our insurers, or debt recovery agents in the event of loss or damage to the Equipment.
vi. You have the right to request access to, correction of, or deletion of your personal data, and to complain to the Information Commissioner’s Office (ICO) if you believe your data rights have been infringed.
